November 16, 2022 (with full applicability from February 17, 2024)

Who does it apply to?

All digital intermediary services operating in the EU, including hosting services, online platforms, and search engines.

Examples:

A social media platform not moderating harmful or illegal content shared by its users.

Impact:

Enhanced user safety, increased platform accountability, and improved content moderation practices.

Risk of non-compliance:

Potential for significant fines and reputational damage due to non-compliance.

Fines:

Member States may impose fines up to 6% of the global annual turnover for serious infringements. For less severe violations, fines can reach 1% of annual turnover. Periodic penalty payments can be up to 5% of the average daily global turnover per day for continued non-compliance.
